IMMEDIATE RELEASEDUI by Massachusetts State Legislator Illustrates Drunk Driving Legal IssuesBrockton MA - August 23, 2004 - Massachusetts State Representative Paul Kujawski's arrest on a DUI this past week illustrates several important issues relevant to DUI defense. Drunk driving attorney Russell Matson, of Brockton, MA comments that the legislator likely made several mistakes that could damage his defense. Reports indicate that he was also charged with "open and gross lewdness" for allegedly urinating in front of the police officer, as well as disorderly conduct. He also was also allegedly described as "rude and combative". "I always advise my clients to be polite at all times", says Matson. "The best thing to do is to politely ask to speak with a lawyer, and not answer any questions, other than producing required documents." Matson went on to add, "Clearly, the alleged lewd behavior can only be damaging to the case at trial." One possibility that might help the defense is that the originating incident was several calls by cell phone from other drivers, who may have been anonymous. "An anonymous tip is not a legally sufficient justification for pulling someone over", said Attorney Matson. "If that is the case, then the police would have to have clearly observed driving behavior themselves that would justify the stop."
